Petitioner apprehends his arrest in a case registered for the offence punishable under Section 302, 201/34 of the Indian Penal Code.

As per the prosecution case, sister of the informant was killed by the FIR named accused persons and threw her dead body in a maize field.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. Petitioner is 2nd wife of the husband of the deceased. There is general and omnibus allegation against her and no specific overt act has been alleged against her. Thrust of accusation is against the husband, who is in custody since 03.06.2020. Petitioner has got clean antecedent.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in connection with Bhawanipur PS case No.103/ 2020, subject to conditions laid down u/s 438(2) of the Cr. P. C.
