The petitioner seeks bail in connection with Chowk P.S. Case No. 123 of 2022 dated 14.03.2022 instituted for the offences under Sections 302/201/34/120(B) of the Indian Penal Code and Section 27 of the Arms Act.
The Informant has alleged that sometimes prior to the occurrence, the petitioner and two others had threatened him to stop the construction work. Shortly thereafter, he was informed that his father has been killed. The Informant therefore suspected the hands of the petitioner and two others. The learned counsel for the petitioner has submitted that he is the next door neighbour of the Informant and the
Patna High Court CR. MISC. No.55682 of 2022(2) dt.16-12-2022 2/2 deceased and, because of land dispute, he has been named in the F.I.R. only on the basis of suspicion.
Till date, no evidence has been collected against the petitioner except for his confession, which the petitioner denies. Under similar circumstances, another accused person of this case with similar allegation has been granted bail in Cr. Misc. No. 54361 of 2022 vide order dated 06.12.2022. The petitioner is in custody since 30.04.2022. Regard being had to the aforenoted facts, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate (Fourth), Patna City in connection with Chowk P.S.
