JUSTICE SATYAVRAT VERMA ORAL ORDER 04-02-2022 Heard learned counsel for the petitioners and learned APP for the State through video conferencing. The petitioners seek bail in connection with Rosera P. S. Case No.277 of 2021, instituted for the offences under Sections 419, 420, 120(B of the Indian Penal Code and Section 10 of Bihar Examination Act, 1981. The learned counsel for the petitioners submits that the petitioners are in custody since 03.09.2021, they are persons with clean antecedent and charge-sheet has been submitted in the case.

The learned counsel for the petitioners submits that the informant alleges that one Abhishek Kumar Ram

The learned counsel for the petitioner submits that petitioner has been falsely implicated in the case. It is submitted that Abhishek Kumar Ram had gone to the centre with the admit card of Santosh Kumar as Santosh Kumar inadvertently left the admit card at home and came to be implicated merely because he was carrying the admit card. The learned counsel further submits that both the petitioners are students and are studying and their entire career would be jeopardized in the event, if the bail is not granted to them, they will come in company of the criminals while being in jail.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioners are in custody, they are persons with clean antecedent and chargesheet has been submitted in the case, the petitioners, abovenamed, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial
