2. The petitioner has preferred this application for grant of regular bail in connection with Rajepur P.S. Case No. 33 of 2024 dated 12.02.2024 registered for the offences punishable u/s 147, 148, 149, 447, 341, 323, 324, 307, 354, 379, 504 and 506 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and the co-accused persons along with 4 to 5 unknown miscreants holding iron pipe and sword came to the door of the informant when he was sitting there and started abusing. On being objected, they attacked on him. When the informant's sons Alok Kumar, Krishn Chand Kumar and Suraj Kumar came on hulla Alok Kumar sustained injury in his hand and head. The coaccused persons Kanhiya Sah, Pappu Sah and Ajay Sah holding

Patna High Court CR. MISC. No.57932 of 2024(3) dt.09-09-2024 2/3 Katta assaulted on his head causing injury. The co-accused Sandeep Sah and Kanhiya Sah assaulted the informant's daughter-in-law and tore her clothes.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is case and counter case between the parties. There is no specific allegation against the petitioner as he is the member of the mob. The specific allegation is against the coaccused persons. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 24.06.2024.

5. Learned A.P.P. for the State and learned counsel for the informant has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case and the nature of allegation levelled against the petitioner as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, East Champaran in connection with Rajepur P.S. Case No. 33 of 2024.
