The petitioner apprehends his arrest in connection with Sathi P.S. Case No. 112 of 2016, registered for the offences punishable under Sections 413, 414/34 of the Indian Penal Code. Allegedly, on the basis of information furnished by co-accused Alamgir, from where several articles were recovered, the house of the petitioner was also raided and from the room of the house in iron trunk, one old bag with old cloths, one cartoon paint, one plastic bag containing paint and one three wheeler tempo bearing registration No. BR22P/7085 were recovered. The petitioner has succeeded in fleeing away and family members did not submit any paper.

Submission is of false implication and that nothing

Patna High Court Cr.Misc. No.7705 of 2017 (3) dt.20-03-2017 2/2 has been recovered from the possession of the petitioner, those articles have not been put on T.I.P., the petitioner is auto driver and he has been made victim of the circumstances and, as such, the petitioner deserves sympathetic consideration. The learned A.P.P. opposes the prayer of pre-arrest bail by pointing out those recovery.

In the facts and circumstances as stated above, considering the recovery of those articles, I am not inclined to grant privilege of pre-arrest bail to him and accordingly his such prayer stands rejected in connection with Sathi P.S. Case No. 112 of 2016, pending in the Court of Sri N.P. Singh, learned Judicial Magistrate, 1st Class, Bettiah, West Champaran. (Jitendra Mohan Sharma, J.) Rajiv/- U T
