JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-03-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Angarh P.S. Case No. 22 of 2014, registered under Sections 366(A), 372 and 506/34 of the Indian Penal Code.

The accusation is of kidnapping of daughter of informant by this petitioner and one Saidul for the purpose to sell her.

Learned counsel for the petitioner submits that while the allegation has been made against the petitioner and one Saidul to kidnap the victim, daughter of the informant, but the victim has stated in her statement, under Section 164 Cr.P.C., that she was enticed away by this petitioner and her

No.8226 of 2017 (2) dt.16-03-2017 marriage was performed with Mahdi Hasan and due to leading of conjugal life, she has two children and she has not stated about ill behaviour by this petitioner. It is further submitted that petitioner has no criminal antecedent and is in custody since 06.06.2016. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the J..M. Ist Class, Purnea, in connection with Angarh P.S. Case No. 22 of 2014. Out of two sureties, one surety must be the close relative of the petitioner.
