JUSTICE BIRENDRA KUMAR ORAL ORDER 19-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 307/341/332/ 333/ 511/ 504/ 506/353/379 and other minor sections of the Indian Penal Code and Section 27 of the Arms Act.
According to the F.I.R. police had gone to arrest this petitioner in connection with the referred case. Allegation is of scuffle with the police and obstruction in the discharge of their official duty rather attacks on the police party with various arms.
Submission of the petitioner is that petitioner is in custody since 25.07.2016 though the petitioner has been named
Patna High Court Cr.Misc. No.9088 of 2017 (5) dt.19-04-2017 2/2 in sixteen serious cases fully disclosed in para-3 of the bail petition but out of that in thirteen cases the petitioner not named and is named only in three cases and in other cases his name was dragged only on the basis of confessional statement of co-accused. Considering the facts and circumstances of this case, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar/Successor Court, in connection with Bagen Gola P.S. Case No.39 of 2014 with condition that one of the bailors shall be a government servant or local public servant Mukhiya etc.
and another family members of the petitioner or his relative residing in the territorial jurisdiction of the Court. With further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
