JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-01-2023 Heard the learned counsel for the petitioner and the learned APP for the State. The petitioner seeks regular bail in connection with Barauli P.S. Case No.199 of 2022, registered for the offence punishable under Section 366A of the Indian Penal Code.

The petitioner is alleged to have kidnapped the minor victim girl, however, it is the case of the petitioner that the victim girl had voluntarily fled away with the petitioner and married him.

Considering the fact that victim girl is minor though I am not inclined to grant privilege

Patna High Court CR. MISC. No. 57108 of 2022(2) dt.20-01-2023 2/2 of bail to the petitioner at this moment, however, as prayed for by the learned counsel for the petitioner, I deem it fit and proper to grant liberty to the petitioner to renew his prayer for bail after framing of charges by the learned trial court. Accordingly, the petition stands disposed off as not pressed.
