JUSTICE SANJAY PRIYA ORAL ORDER 17-02-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in Suryagarha (Manikpur) P.S. Case No. 201 of 2010 instituted for the offence under Sections 409,419,420,467,468,353/34 of the IPC. From the impugned order, it appears that the case is of the year 2010. Charge-sheet was submitted on 07.03.2012 for the offences under Sections 409,420,467,468,354,34 of the IPC and despite various steps taken by the court including issuance of nonbailable warrant and the process u/s 82 of the Cr.P.C. the petitioner did not surrender.

Learned counsel for the petitioner submits that other accused persons have already been granted anticipatory bail by coordinate Benches of this Court vide order dated 24.06.2011

Patna High Court Cr.Misc. No.5202 of 2018 (3) dt.17-02-2018 2/2 passed in Cr. Misc. No. 17023 of 2011 and vide order dated 01.08.2011 passed in Cr. Misc. No. 21960 of 2011. Considering the facts that process of 82 Cr.P.C. has already been issued and petitioner has not surrendered in this case even after submission of charge-sheet on 07.03.2012, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this anticipatory bail petition stands rejected.

The petitioner is directed to surrender in the court below within six weeks from today and seek regular bail which will be considered by the court below in accordance with law and disposed off, without being prejudiced by this order. (Sanjay Priya, J) khushbu/- U T
