The petitioner is accused in connection with Muffasil P.S. Case No. 34/2016, registered under Sections 147, 148, 149, 341, 323, 325 and 307 of the Indian Penal Code. The accusation is that seven persons, named in the FIR, armed with lathi, stick, axe and khanti reached near Sanjeet Paswan, son of the informant. Gawaskar Paswan and Rohit Paswan caught Sanjeet Paswan. Thereafter, Arti Devi, Sajan Devi and Punam Devi, on instruction of Ramdas Paswan, started assaulting the son of the informant. When the informant Bhagwan Paswan went to save Sanjeet Paswan, on the order of Ramdas Paswan, petitioner Prabhash Paswan caused injury on the head of
Patna High Court Cr.Misc. No.17621 of 2017 (2) dt.04-05-2017 the informant, whereas Ramdas Paswan also caused injury at his hand. Arti Devi and Sajan Devi also assaulted the informant. At that time, Gawskar Paswan also assaulted Sanjeet Paswan, son of the informant, on his head.
Submission is that specific allegation has been made against the petitioner that he assaulted the informant with axe, but three injuries are found on the person of the informant, which are simple in nature.
Having regard to the facts and the circumstances of the case, the petitioner, Prabhash Paswan, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Munger, in connection with Muffasil P.S. Case No. 34/2016.
