JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-04-2018 The petitioner is apprehending his arrest in connection with Hathauri P.S. Case No. 89 of 2016, registered for offences punishable under Section 302, 201 and 34 of the Indian Penal Code.
Petitioner happens to be the husband of the deceased and allegation is of causing death of the deceased. It has been submitted on behalf of the petitioner that the petitioner at the time of death of the deceased was not present and in fact the deceased died due to illness.
Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances of the case, this is not a fit case for grant of anticipatory bail and the same is accordingly dismissed. However, if the petitioner so desire may surrender before the court below
Patna High Court Cr.Misc. No.10917 of 2018 (4) dt.19-04-2018 2/2 and pray for regular bail, which will be considered by the court below on the merit of the case, without being prejudiced by the order of this Court.
