The petitioner is accused in connection with Digha P.S. Case No. 44 of 2015, registered under Section 366(A)/34 of the Indian Penal Code.
The accusation is of kidnapping of minor daughter of the informant by this petitioner with the help of his friend Gaurav and his other family members.
Learned counsel for the petitioner submits that, in fact, due to love affairs, daughter of the informant moved with this petitioner and stayed at Delhi, but with ulterior motive after returning from there, she gave her statement under Section 164 of the Cr.P.C. regarding her kidnapping by this petitioner and one Gaurav and also keeping her by this petitioner at his house at
Patna High Court Cr.Misc. No.9679 of 2017 (2) dt.10-03-2017 2/2 Muzaffarpur and on protest by his mother, the petitioner took her at Delhi from where she was taken by her brother to Patna. Further submission is that the age of the victim has been assessed in between 17 to 18 years. Later on, the victim and her mother filed a compromise petition in the Court of SDJM, Patna on 19.12.2016. The petitioner having no criminal antecedent in custody since 15.11.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the SDJM, Patna in connection with Digha P.S. Case No. 44 of 2015.
