JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-11-2019 This application, for grant of anticipatory bail, arises out of Begusarai Town P.S. Case No. 364 of 2018, disclosing offences under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation as per F.I.R. is that while the informant and his son was returning to their home, in the meantime, some miscreants fired on his son causing injury on his head, due to which he succumbed to his injury. F.I.R. was lodged against unknown. Later on one person was apprehended, who disclosed the name of petitioner as his associate in the offence. Submission of learned counsel for the petitioner is that he has no criminal antecedent and he has been made accused only on the basis of confession of co-accused Ajay Kumar, who himself in his confessional statement, has admitted

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Begusarai Town P.S.
