JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-11-2019 Petitioners seek bail in anticipation of their arrest in connection with Ramgarhwa P.S. Case No. 188 of 2018 registered for the offences punishable under Sections 304B, 120B and 201 of the Indian Penal Code.
Petitioners are said to be father-in-law, mother-in-law and brothers-in-law of the deceased and the case is of dowry death.
Submission of learned counsel for the petitioners is that as earlier deceased was traceless case under Section 365 and other sections of the Indian Penal Code has been lodged
Patna High Court CR. MISC. No.51895 of 2019(3) dt.04-11-2019 2/2 against the husband and others, who have been granted regular bail/anticipatory bail and the present case has been lodged when dead body of deceased was recovered and no specific allegation has been attributed against any of the petitioners. Heard learned APP also.
In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the S.D.J.M., Raxaul, East Champaran, in connection with Ramgarhwa P.S. Case No. 188 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
