The petitioner had applied for the post of constable (G.D.) in the Para Military Forces. Claim has been made that
Patna High Court CWJC No.2464 of 2013 dt.07-09-2016 2/2 though he has obtained 67 marks in the examination, but has not been selected and the persons who are below him have been selected.
Learned counsel for the Union of India has taken a plea that this Court has no jurisdiction to hear this case on account of the fact that all the tests either written test or medical test having been taken in the State of Jharkhand and as such, the jurisdiction lies to the High Court of Jharkhand, Ranchi, not with this Court. I have perused the record of the case. Annexure- 1 and 3 of the writ application show that written test as well as medical test was conducted either in Ranchi or at Hazaribagh. In such view of the matter, this court is of the view that this petition is not maintainable on account of territorial jurisdiction. Hence, this writ application is dismissed as not maintainable. The petitioner, if so advised, may approach to the appropriate forum for redressal of his grievance. (Shivaji Pandey, J) pawan/- AFR/NAFR A.F.R.
