The petitioner, already in custody, seeks bail in connection with G.O. Case No. 22 of 2017 registered under Section 30(a) of the Bihar Excise Prohibition Act, 2016. Allegation in brief is that the Excise official raided the house of the petitioner and recovered 15 litres of Gur Jawa and 15 litres of illegal country made liquor.

Learned counsel for the petitioner submits that nothing was recovered from the possession of the petitioner and he has got no antecedent of any nature and has been in custody in this case since 09.01.2017.

Having considered the aforesaid facts and

Patna High Court Cr.Misc. No.9285 of 2017 (3) dt.15-03-2017 2/2 circumstances, the petitioner, namely, Asheshwar Mahto, is directed to be released on bail upon furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned Special Judge-cum-District and Sessions Judge, Darbhanga in connection with G.O. Case No. 22 of 2017.
