JUSTICE SANJAY PRIYA ORAL ORDER 04-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Pachrukhi (GB Nagar) P.S. Case No. 128 of 2015 instituted for the offence under Sections 304(B) and 201/34 of the Indian Penal Code. Petitioner is husband of the deceased.
As per written report the marriage of the petitioner with the deceased took place on 12.4.2012. She was tortured in her sasural for demand of dowry by petitioner and his family members. It is alleged that when she became pregnant, petitioner did not take care of her during pregnancy and after birth of a male child, petitioner did not come to see his son. It is further alleged that when the informant went to her daughter's matrimonial home on 17.3.2015, she did not find her daughter there. She learnt that
Patna High Court Cr.Misc. No.13144 of 2017 (4) dt.04-05-2017 2/2 his daughter died due to burn injuries and body has been buried by the accused persons.
From the complaint petition itself it appears that dead body of the informant's daughter was buried without informing the family members of the informant.
Therefore, this Court is not inclined to grant bail to the petitioner.
Prayer for bail of the petitioner stands rejected. The trial court is directed to expedite the trial. Petitioner may renew his prayer for bail after nine months if no substantive progress is made in the trial. (Sanjay Priya, J) S.Ali/- U T
