This application is for modification in earlier order passed by this Court, vide order dated 3.3.2017 passed in Cr. Misc. No.55279 of 2016, by which the petitioner was granted provisional bail for a period of six months and only on a condition that both the parties will live together and after satisfying with their conduct, the learned trial court will confirm the bail bond of the petitioner, otherwise he is free to pass any other order or orders.

Submission of the learned counsel for the petitioner is that O.P.No.2 is not ready to live with the petitioner and she has filed a domestic violence case in another court. Heard learned A.P.P. also.

Patna High Court Cr.Misc. No.22891 of 2018 (2) dt.19-04-2018 2/2 Having heard both sides and in such view of the matter, the petitioner is directed to approach the learned trial court along with his grievances and the learned trial court will call for both the parties and after hearing both the parties he will pass appropriate order without being prejudiced by the order of this Court.

With the aforesaid direction, this application is disposed of.
