The petitioners apprehend their arrest in Sadar P.S. Case No. 102 of 2016, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act.
Krityanand Mahaldar, the informant, named the petitioners along with other accused persons and made omnibus and general allegation of assault against the petitioners and others. The informant made specific allegation that Tallu Murmu gave arrow blow on his chest and Bablu Soren gave arrow blow on the hand of Devendra Mahaldar, the brother of the informant.
Patna High Court Cr.Misc. No.11251 of 2017 (2) dt.28-03-2017 2/2 Learned counsel for the petitioners submits that no other injury was found on the persons of the informant and his brother. No specific allegation of assault is made against the petitioners.
Considering the facts aforesaid, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in Sadar P.S.
