The instant application for regular bail has been filed by the petitioner registered for the offence punishable under Sections 363 and 366 of the Indian Penal Code and Section 8 of the POCSO Act.
AS per allegation in the FIR, on 26.5.2023, in the morning when informant woke up she saw that her minor daughter is missing thereafter search was made but all in vein. It is further alleged that informant with her other family members went to the house of Bambam yadav to search her daughter, then petitioner and others have assaulted them.
Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no
Patna High Court CR. MISC. No.60932 of 2023(2) dt.15-09-2023 2/2 offence. Specific allegation is against accused Bambam Kumar who alleged to be taken the informant's daughter. Being the father of main accused, against whom there is specific allegation of abduction, petitioner has been falsely implicated in this case. No specific allegation is levelled against the petitioner. Petitioner has got no criminal antecedent and languishing in judicial custody since 5.6.2023.
Learned APP appearing for the State has opposed the prayer of Bail and submitted that victim girl is still traceless. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ADJ VI Saharsa cum-Special Judge POCSO Saharsa in connection with Saharsa P.S. Case No. 342 of 2023.
