1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Bhaptai Yahi Police Station Case No. 02 of 2025, disclosing offences under Sections 96 and 3(5) of the BNS, 2023.
3. As per the FIR, the minor daughter of the informant was abducted/kidnapped by the petitioner and was kept at Delhi, Gurgaon.
4. Learned counsel for the petitioner submits that the petitioner has not committed any offence as alleged and he has falsely been implicated in the present case merely because

In her statement recorded under Section 180 of the B.N.S.S. 2023, the victim girl has stated that she was being tortured/scolded by her father due to which she went to Delhi along with her neighbour Angad Kumar i.e., petitioner. When the victim girl came to know about the case, she voluntarily came back to her home. She has also stated that nobody has kidnapped her.

Having regard to the submissions made on behalf of the parties and taking into consideration the statement of the victim girl, recorded under Section 180 of the B.N.S.S., 2023, in which she has stated that she had voluntarily gone with the petitioner on her sweet will, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Bhaptai Yahi Police Station Case No. 02 of 2025, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482(2) of the
