This is an application for bail in connection with Rail Mansi P.S.Case No. 21 of 2016 registered for the offences punishable under Section 379 of the Indian Penal Code. It has been submitted on behalf of the petitioner that petitioner is not named in the FIR but later on on the basis of statement of one Samshad, who told that he purchased one Samsung Mobile, which is stolen article, from the petitioner, and, as such, he has been implicated in this case and he has remained in custody since 9.1.2017.
Heard learned APP also.
Having heard both sides and from perusal of the record it appears that apart from this case there is one more case against the petitioner of similar nature, I am not inclined to grant
Patna High Court Cr.Misc. No.9854 of 2017 (2) dt.01-03-2017 2/2 bail to the petitioner at this stage. However, petitioner may renew his prayer for bail before the court below itself after three months in custody, who will consider the same keeping in view the period of detention and pass appropriate order, without being prejudiced by this Court, Accordingly, this application is disposed of.
