The petitioner seeks bail in a case registered under Section 395 of the Indian Penal Code.

Allegation is that nine unknown miscreants on the point of pistol looted Rs.3 lakhs and some other articles from the shop of the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.03.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on confessional statement of co-accused. The petitioner has not been put on T.I.P. There is no recovery of any incriminating article from the

Patna High Court CR. MISC. No.50486 of 2019(2) dt.14-08-2019 2/2 possession of the petitioner. Other co-accused has been granted bail vide Annexure 2 to the present application. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. case No.29 of 2019.
