Petitioner is apprehending his arrest in Kateya P.S.Case No.198 of 2016 registered for the offences under Sections 147, 148, 149, 302 and 120(B) of I.P.C.

Allegation against the petitioner is of assault to the brother of the informant causing his death.

Submission of the learned counsel for the petitioner is that there is general and omnibus allegation against the petitioner and no any specific allegation is attributed to the petitioner. Heard learned A.P.P. also. who opposed his prayer stating that the allegation against the petitioner is of assault. Having heard both sides and in view of the facts and circumstances and also there is allegation of assault against the

Patna High Court Cr.Misc. No.24718 of 2018 (2) dt.04-05-2018 2/2 petitioner, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner. Prayer for anticipatory of the petitioner is rejected.

Accordingly, this application is dismissed.
