====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 27-08-2019 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act. A country made loaded pistol was recovered from possession of the petitioner. Firearm was also recovered from possession of other co-accused. Suspicion has been raised that they were preparing to commit dacoity. Petitioner is in custody since 14.02.2019. Investigation of the case is already complete against the petitioner.

Considering the entire facts aforesaid, let the petitioner, above named, be released on bail, after framing of the charges against the petitioner, on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the

No.52774 of 2019(2) dt.27-08-2019 2/2 like amount each to the satisfaction of learned Court below where the case is pending in connection with Chakia Police Station Case No. 40 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
