This application has been filed for modification of the order dated 22.12.2016 passed in Cr.Misc. No.54289/16 whereunder the petitioner was directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria in connection with Excise Case No.222C3 of 2016, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. Submission is that bail bond of the petitioner could not be accepted due to receipt of another order dated 21.12.2016 passed in Cr. Misc. No.54289 of 2016 showing wrong title in

Patna High Court Cr.Misc. No.9519 of 2017 (2) dt.08-03-2017 2/2 Criminal Misc. No. 54289 of 2016 which was corrected later on vide order dated 17.01.2017 passed in criminal Misc. No. 54289 of 2015. As such, four weeks time be allowed for surrender of the petitioner in the court below.

In view of the submission, four weeks' further time is allowed to the petitioner to surrender before the court below. Order dated 22.12.2016 is modified to the extent stated above. Accordingly, modification application stands disposed of.
