The petitioner apprehends his arrest in Sirdalla P.S. Case No.232 of 2019 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the recovery was made from the place situated near the house of Binod Kumar and not from possession of the petitioner but the name of the petitioner also figured in the case without any recovery from the conscious possession of the petitioner. It appears that the petitioner has got criminal antecedent of the same nature.

Having considered the facts aforesaid and the fact

Patna High Court CR. MISC. No.52084 of 2019(2) dt.21-08-2019 2/2 that the petitioner has got criminal antecedent of the same nature, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
