The petitioner, being the mother-in-law of the deceased, is facing prosecution under Section 304B of the Indian Penal Code.

The occurrence was committed on 22.07.2001 when the victim was done to death in a suspicious circumstance within three years of her marriage while she was at Sasural. The prosecution has also alleged torture on her before causing her death by the in-laws including the husband.

Learned counsel submits that the petitioner being a lady deserves bail. Unaware of the present case, she was in Madhya Pradesh and, therefore, she could not surrender for few years. From the impugned order, it appears that the petitioner

Patna High Court Cr.Misc. No.6573 of 2017 (3) dt.16-03-2017 2/2 absconded for over a decade. The post mortem report indicates that the victim was burnt by the accused persons while she was at the Sasural.

Considering the seriousness of the allegation and the fact that she absconded for a long time, I am not inclined to grant privilege of bail to the petitioner. Prayer is rejected. The Trial Court shall endeavour to expedite the trial.
