The petitioner apprehends his arrest in connection with Rajouli P.S. Case No. 247 of 2021 registered under Sections 30(a)/37(c)/41 of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. From perusal of seizure list, it is apparent that the alleged recovery has been made from the forest of the village. Nothing has been recovered from the conscious possession of this petitioner.

Having considered the above facts and circumstances of the case, let the above named petitioner be released on bail, in

No.58791 of 2022(3) dt.25-02-2023 2/2 the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Exclusive Special Excise Court-II, Nawada in connection with Rajouli P.S. Case No. 247 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
