JUSTICE SANJAY PRIYA ORAL ORDER 06-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Baisi P.S. Case No. 230 of 2016 instituted for the offence under Section 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2016.
It has been submitted that the petitioner has clean antecedent. As per the written report, he was found seated on the motorcycle from which foreign liquor is alleged to have been recovered.
It is alleged in the written report that total 23 liters of foreign liquor was recovered from the motorcycle on which the petitioner and Amardip Kumar were found seated. The petitioner is in custody since 5.1.2017. It is mentioned in paragraph-3 of the
Patna High Court Cr.Misc. No.7912 of 2017 (2) dt.06-03-2017 2/2 bail petition that the petitioner has no criminal antecedent. Keeping in view the clean antecedent and the period spent by the petitioner in custody, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Baisi P.S.
