2. Petitioners apprehend their arrest in a case instituted under Section 30(a) of the Bihar Prohibition and Excise Act.

3. There is recovery of 80 litres of country made liquor from a scooty.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case on suspicion. Nothing has been recovered from conscious possession of the petitioners. Petitioners are neither owners of the scooty nor they have any concern with the recovered illicit liquor. They were not present on the spot. Petitioner no.1 has

Patna High Court CR. MISC. No.58603 of 2025(2) dt.22-09-2025 2/2 one criminal antecedent of similar nature in which he is on bail whereas petitioner no has no criminal antecedent. Petitioners undertake to cooperate in the investigation and the trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Court concerned in connection with Parsa P.S. Case No.106 of 2025, subject to the conditions as laid down in Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
