Petitioners apprehend arrest in connection with Danapur P.S. Case No. 412 of 2022 registered for the offence under sections 30(a) and 38(ii) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioners submits that petitioners have not committed any offence as alleged in the first information report and they have been falsely implicated in this case. Petitioners are not the owner of the vehicles which have been seized. The owner of Scooty bearing registration No.

Patna High Court CR. MISC. No.55080 of 2022(5) dt.04-02-2023 2/2 BR-01ED-1566 belongs to one Sunny Kumar and petitioner no. 1 is owner of Scooty bearing registration no. BR-01CL 8284 and not BR 01 CL 8244. Petitioners have no criminal antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioners, above named, are directed to be released on bail on furnishing personal bond to the satisfaction of Special Judge, Excise, Danapur in connection with Danapur P.S. Case No. 412 of 2022 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
