Heard learned counsel for the petitioner and the learned APP for the State.
The petitioner apprehends his arrest in connection with Bikram P.S. Case no. 41 of 2021 registered under sections 307, 354B and other allied section of the Indian Penal Code. The main submissions advanced by learned counsel for the petitioner are that the petitioner is simply named in the F.I.R and there is no allegation of any participating in the alleged occurrence actively and the main allegation is against co-accused persons Sidhnath Paswan and Vinod. Admittedly, there is land dispute between the parties and two co-accused
Patna High Court CR. MISC. No.64712 of 2021(2) dt.16-06-2022 2/2 persons carrying similar nature of allegation have been granted anticipatory bail by a coordinate bench of this court vide order dated 10.5.2022 passed in Cr. Misc. no. 54325 of 2021. Learned APP opposes the prayer for anticipatory bail. Considering the above submissions and petitioner's case being similar to co-accused persons referred to above who are enjoying anticipatory bail, let the above named petitioner, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate VI, Danapur District Patna in connection with Bikram P.S. Case no. 41 of 2021 subject to condition as laid down under section 438(2) Cr.P.C.
