This is an application for grant of anticipatory bail in connection with Bettiah (T) P.S. Case No. 402 of 2019, disclosing offences, punishable under Section 366(A)/34 of the Indian Penal Code and Section 8 of the POCSO Act. For the sole reason that the petitioners have annexed part of the case diary, which is the statement of the victim recorded under Section 161 of the Cr. P.C., I am not inclined to entertain this application for anticipatory bail. This application is accordingly dismissed.

No.51464 of 2019(2) dt.19-08-2019 2/2 However, considering the submission made on behalf of the petitioners that no role is attributable to them and their implication is only because they are related to the main accused Md. Mustafa Quraisi, it is directed that if the petitioners surrender in the court below within four weeks from today and seek regular bail, the court below shall consider their application for regular bail on its own merit, the same day, without being prejudiced by the rejection of the present anticipatory bail application.
