The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 406, 407, 408, 409, 420 of the Indian Penal Code.

As per prosecution case, the allegation against the petitioner is that he in connivance with co-accused misappropriated the Government money being Secretary of ward Functional and Management Committee.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The

He has got no criminal antecedent. As per Annexure-2, it appears that the petitioner has already completed the work and drinking water supply system at Ward-13 is properly functioning but due to delay in execution of work under Nal Jal Yojna, certain entry has not been made in MB Book and only on wrong presumption the FIR has been lodged against him. It is further submitted M.B. Book also shows entry of execution of work up to Rs. 9,54,990/- out of total amount Rs. 13,09,000/-. The petitioner is languishing in judicial custody since 30.01.2023.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Daudnagar P.S. Case No. 181of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the
