Petitioners are apprehending arrest in connection with Kotwali (Tilkamanjhi) P..S. Case No. 841 of 2017 for the offence under sections 147, 148, 149, 323, 324, 504, 506 and 307 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioners submits that in the instant case there is no allegation of any overt act against these petitioners. They are only members of the assembly. From the FIR, it appears that firing was done by Raushan Kumar and Golu Sah and not by these petitioners. There is no allegation that they were equipped with any fire-arm.

No.14549 of 2018(2) dt.06-04-2018 2/2 In view of the above, let the petitioners, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate,Bhagalpur, in connection with Kotwali (Tilkamanjhi) P.S. Case No. 841 of 2017 subject to the condition as laid down under section 438(2) of the Cr.P.C.
