The petitioner seeks regular bail in connection with Allauli P.S. Case No. 270 of 2016 (GR No. 2301 of 2016) registered for the offences punishable under Sections 493, 376, 504, 506 and 34 of the Indian Penal Code and Sections 3(i)(w) of the SC & ST Act.
Learned counsel for the petitioner submits that the case has been instituted on account of misunderstanding. The informant is a major lady with whom the petitioner had love affairs. They subsequently performed marriage on 18.11.2016 just after 16 days of institution of this case. The informant and
Patna High Court Cr.Misc. No.10046 of 2017 (2) dt.15-03-2017 2/2 the petitioner started residing together and subsequently surrendered before the court below. Other co-accused, who happens to be the father and other family members including one neighbour have been allowed bail by the learned court below. A compromise petition to this effect has already been filed before the Court below.
Learned Special Public Prosecutor opposed the submission of bail. However, learned counsel for the informant supported the contention of the learned counsel for the petitioner.
Considering the facts and circumstances stated above, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Additional Chief Judicial Magistrate, Khagaria in connection with Allauli P.S. Case No. 270 of 2016 (G.R. No. 2301 of 2016). (Sanjay Kumar, J) ajaypd./- U T
