JUSTICE SANJAY PRIYA ORAL ORDER 21-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Bithan P.S. Case No.143 of 2016 instituted for the offence under Sections 147, 148, 149, and 302 of the Indian Penal Code and Section 27 of the Arms Act. As per written report, on the order of this petitioner, the other accused made indiscriminate firing on the Bhabhi of the informant, on account of which, she succumbed to her injury. From the order of learned Sessions Judge itself, it appears that there is no any specific overt act against this petitioner.
The petitioner is said to be in custody since 20.11.2016 and he has clean antecedent.
Considering the aforesaid facts and circumstances,
Patna High Court Cr.Misc. No.11040 of 2017 (2) dt.21-03-2017 2/2 the prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur, in connection with Bithan P.S. Case No. 143 of 2016 (G.R. No. 1191 of 2016), subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) Ravi/- U T
