The petitioners apprehend their arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code and Section 27 of the Arms

Patna High Court CR. MISC. No.66628 of 2021(2) dt.24-05-2022 2/3 Act.

As per the prosecution case, on 16.05.2021 at about 6:00 PM, while the informant was at his home, these petitioners alongwith 10-15 unknown persons, variously armed, came there and assaulted informant and his family members. It is submitted on behalf of petitioners that there is case and counter case and the present case is counter blast of Manigachhi P.S. Case No. 116 of 2021, which was lodged by son of petitioner no. 1 against the informant and his family members. The genesis of the occurrence is that the informant solemnized love marriage with minor daughter of petitioner no. 1, for which, Manigachhi P.S. Case No. 241 of 2020 was lodged by wife of petitioner no. 1 against informant and his family members. In fact, a free fight took place between the parties and both sides sustained injury. Petitioner no. 1 & 4 are government servants and posted in Police department. Petitioners claim clean antecedent Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be

P.S. Case No. 111 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
