The petitioners are in custody in connection with Bhore P.S.Case No.219 of 2016 registered for an offence under Sections 366(A)/34 of the IPC.

The allegation is that this petitioner and two others who are named in the FIR abducted the minor daughter of the informant for the purpose of marrying her.

Learned counsel for the petitioners submits that the daughter of the informant is a major girl as her age was determined in between 17 to 18 years by the doctor. She voluntarily had left her place. The learned counsel while citing the statement of victim recorded under Section 164 of the Cr.P.C. submitted that she has not anything against the petitioner. The

Patna High Court Cr.Misc. No.5889 of 2017 (2) dt.22-02-2017 petitioner is father of co-accused Sujit Thakur who allegedly abducted the victim. The petitioner is in custody since 12.11.2016. However, learned APP opposed the prayer for bail. Considering the nature of allegation as also the fact that the victim has not stated about participation of any other accused, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of ACJM-XII, Gopalganj in connection with Bhore P.S.Case No.219 of 2016.
