Also heard Mr. Siya Ram Shahi, learned Counsel, appearing on behalf of respondent no.8.

With the help of this writ petition, made under Article 226 of the Constitution of India, in the form of Public Interest Litigation, petitioners seek removal of the encroachment made over Old Khata No. 609, New Khata No. 852, Old Plot No. 3080, New Plot No. 128.

Having regard to the nature of facts brought on

Patna High Court CWJC No.15850 of 2015 (4) dt.04-04-2016 2 / 2 record, we close this writ petition with liberty granted to the petitioners to make appropriate petition before the Circle Officer, Nawada. If such an application is made, the Circle Officer, Nawada shall do the needful in accordance with law, preferably, within a period of three months from the date of making of application by the petitioners.

With the above observations and directions, this application stands disposed of.
