The petitioner seeks bail in Gaya Rail P.S. Case No. 54 of 2017 instituted under Section 30(a) of the Bihar Excise Act and Section 137 of the Railway Act pending in the Court of the Railway Judicial Magistrate, Gaya.
As per the written report this petitioner was arrested by the police while trying to escape from a passenger train. He was trying to unload two bags from the train. The police recovered 120 liters of country made Mahua liquor from the aforesaid two bags. The seizure list was prepared which bears the signature of the petitioner.
Keeping in view the nature of allegation and the
Patna High Court Cr.Misc. No.19039 of 2017 (2) dt.28-04-2017 2/2 recovery of huge quantity of country made Mahua liquor from possession of the petitioner, I am not inclined to grant bail to the Petitioner.
Prayer for bail is rejected.
The petitioner may renew his prayer for bail after completing six months in custody in the court below which shall be disposed of in accordance with law.
