Earlier bail applications of the petitioner were rejected vide Cr. Misc. No. 13039 of 2019 under order dated 15.04.2019 and Cr. Misc. No. 16081 of 2021 under order dated 15.09.2021, annexed as Annexure-1 series to the present application taking into account that 5.500 kgs. Opium is said to have been recovered from possession of the petitioner.

This is third attempt on behalf of the petitioner for grant of bail.

A report was called for from the court below

Patna High Court CR. MISC. No.57962 of 2022(5) dt.05-04-2023 2/2 regarding the present stage of the case. It has been reported that out of six prosecution witnesses, three prosecution witnesses have already been examined and the trial is likely to be concluded within a period of six months.

Considering the same, I am not inclined to grant bail to the petitioner. The same is rejected in NCB Case No. 12 of 2018, pending in the court of learned Additional Sessions JudgeI, Gaya. Zonal Director, Narcotics Control Bureau, Patna, is directed to take all necessary steps to produce the witnesses on the date fixed in the court below so that the trial could be concluded within the stipulated period.

Let a copy of this order be handed over to Mr. Manoj Kumar Singh, Central Government Counsel, for taking necessary steps in the present matter.
