Petitioner is accused in connection with Dumariya Ghat P.S. Case No. 38 of 2017 registered for the offences under Sections 30(a) of the Bihar Excise (Amendment) Act, 2016. Learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner. Recovery has been made from the hosue of one Vijay Rai with whom petitioner has no concern. It is submitted that petitioner has no criminal antecedent and is in custody since 08.03.2017.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on

Patna High Court Cr.Misc. No.19778 of 2017 (2) dt.05-05-2017 2/2 furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari in connection with Dumariya Ghat P.S. Case No. 38 of 2017.
