In this case, the petitioner is making a grievance that he was asked to organize Chhath Mela Cheti / Kartik 2014-15, awarded the provisional Parwana for the same and for that the petitioner has deposited Rs. 3,42,000/- but, a complaint has been made that on the day of holding Mela, the petitioner was prevented by the district administration to organize the same and asked the petitioner to organize the Mela at a different place which caused an immense loss to the petitioner as well as it is against the provisional Parwana which was issued to him. Learned counsel for the petitioner submits that when he was prevented to organize Mela, on the same day, he has
Patna High Court CWJC No.5992 of 2015 dt.03-02-2017 filed an application bringing on record the connected fact with regard to holding of the Meal but, the same does not give any result and is pending till date.
Let the petitioner file a detailed representation before the Divisional Commissioner, Patna bringing all the facts in his notice and the Divisional Commissioner, Patna will consider the case of the petitioner and take a decision by passing a reasoned order in accordance with law. While deciding the case, the aforesaid Authority will also give an opportunity of hearing to the petitioner. If the petitioner files a representation before the Divisional Commissioner, Patna within a period of two weeks from today, the aforesaid Authority is directed to dispose of the same within a period of four months from the date of filing of the representation by the petitioner along with a copy of this order. With the aforesaid observation and direction, this application is disposed of.
