The petitioners apprehend their arrest in connection with Bettiah Muffasil (Manuapul) P. S. Case No. 421 of 2017 registered for the offences punishable under Sections 147, 148,
Patna High Court Cr.Misc. No.17186 of 2018(2) dt.06-04-2018 2/3 149, 323, 337, 338, 332, 333, 353, 307, 153(A), 295 (A) of the Indian Penal Code.
Allegedly, after receiving information about riot in between two communities at village Siyarosatti Guruwaliya, the informant and other police personnel went there and saw that both communities were pelting bricks upon each other and were using filthy languages. People of one community were intended to demolish the religious worship place. The Police tried to pacify them but they attacked on the Police party also. Submission is of false implication and that there is no specific allegation against the petitioners, none of the members of the two community have sustained injury either simple or grievous, nine other similarly situated co-accused have been allowed bail vide Cr. Misc. No. 7752 of 2018 by another coordinate Bench of this Court vide annexure-2 and as such the petitioners deserve sympathetic consideration.
Learned APP fairly submits that similarly situated other co-accused have been allowed pre-arrest bail.
Patna High Court Cr.Misc. No.17186 of 2018(2) dt.06-04-2018 3/3 bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Bettiah Muffasil (Manuapul) P. S. Case No. 421 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
