Petitioner seeks bail in a case registered for the offences punishable under Section 120B of the Indian Penal Code, Section 3⁄4 of the Explosive Substance Act and Sections 13, 16, 18, 19, 20 of the Unlawful Activities Act.

Petitioner is in custody since 01.03.2016.

On the information of the spy, the police raided the house of Ram Pravesh Rai and recovered explosive substances. Allegation is that the petitioner is also involved along with the aforesaid co-accused.

Submission is that the petitioner was not apprehended on the spot. Nothing was recovered from his

Patna High Court Cr.Misc. No.16723 of 2017 (3) dt.16-05-2017 2/2 possession and, merely, on suspicion, he has been named in this case.

Considering the period already undergone and the material aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional Sessions Judge, Patna/successor Court in connection with S. Tr. No. 71(A) of 2016 arising out of R.K. Nagar Police Station Case No. 146 of 2015, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below.
