The petitioner seeks bail in a case registered for the offence under Section 363, 365 of the Indian Penal Code. As per the prosecution case, on 04.03.2021 at about 7:00 PM, son of the informant was sitting at his door and after 10-15 minutes, he went missing and still traceless. Petitioner is not named in the F.I.R. Name of the petitioner has transpired during course of investigation in the confessional statement of co-accused Krishna Yadav. Only suspicion has been raised against this petitioner due to previous dispute. Save and except suspicion, there is no material against this petitioner to show his involvement in the aforesaid crime. Petitioner claims clean antecedent and is in custody since 08.03.2021. Investigation is complete.

Patna High Court CR. MISC. No.64427 of 2021(3) dt.10-05-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge - VI, Siwan in connection with Sessions Trial No. 274 of 2021, arising out of Maharajganj P.S. Case No. 64 of 2021.
