The petitioner apprehends his arrest in connection with Barachatti P.S. Case No.72 of 2012 registered under Section 18 of the N.D.P.S. Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. It is further submitted that the land over which opium was allegedly cultivated does not belong to the petitioner. The petitioner has got no criminal antecedent.

Having considered the above facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below

Patna High Court CR. MISC. No.58775 of 2022(4) dt.20-04-2023 2/2 within a period of four weeks from today, on furnishing personal bond to the satisfaction of Sessions Judge-cum-Special Judge (NDPS Act), Gaya in connection with Barachatti P.S. Case No.72 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
