====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 23-08-2023 Heard Mr. Avnish Kumar Singh, learned counsel appearing on behalf of the petitioner and Mr. Akbar Ali, learned A.P.P. for the State.
2. The petitioner apprehends his arrest in connection with Bhagwan Bazar P.S. Case No. 484 of 2022, registered under Sections 147, 148, 341, 323, 324, 307, 379, 354 and 504 of the Indian Penal Code.
3. The prosecution case, in brief, is that all the accused persons named in the F.I.R., including the petitioner, assaulted the informant. The specific allegation against the petitioner is that he has assaulted Rahul, brother of the informant.
4. Learned counsel appearing on behalf of the petitioner submitted that the petitioner is innocent and he has

He further submitted that it is alleged that petitioner assaulted the brother of the informant, but the injury sustained by Rahul, brother of the informant, is simple in nature. He further submits that the specific allegation is against Mukesh Kumar, who was watching the sister-in-law of the informant with bad eye and has assaulted the informant brutally on the vital part of his body. He further submitted that similarly situated four co-accused has already been released on bail by a co-ordinate Bench of this Court on 17.07.2023 passed in Criminal Miscellaneous No. 30471 of 2023. The petitioner has clean antecedent.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner.

Having heard the rival submissions of the parties and the fact that other four co-accused have already been released on bail by a co-ordinate Bench of this Court, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M-1, Saran, Chapra in connection with Bhagwan Bazar P.S. Case No. 484 of 2022,
